These terms govern your use of emisha.africa and the Emisha platform. By accessing either, you agree to these terms.
If you are accessing Emisha on behalf of a company, you confirm that you have authority to bind that company to these terms.
Who these terms apply to.
These terms apply to:
- Visitors to emisha.africa
- Registered users of the Emisha platform (Source, Build, Proof, Send, Filer, and Syntio when available)
- Anyone who books a demo or submits an enquiry
Using the website and platform.
You may use emisha.africa and the Emisha platform for lawful purposes only. You agree not to:
- Use the platform to store, transmit, or process unlawful content
- Attempt to gain unauthorised access to any part of the system
- Interfere with the operation of the platform or its infrastructure
- Reverse-engineer, copy, or reproduce any part of the platform without written permission
Your account.
If you have an Emisha account, you are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. To report unauthorised access, contact
Your content.
Content you upload or create within the Emisha platform remains yours. You grant Emisha a limited licence to store, process, and display your content solely to provide the service to you.
We do not claim ownership of your content and we do not use it for any purpose beyond operating the platform.
Intellectual property.
The Emisha platform, website, brand, and all associated materials are owned by Emisha Sourcing Services (Pty) Ltd. Nothing in these terms transfers ownership of any Emisha intellectual property to you.
The Emisha name, logo, and product marks may not be used without written permission.
Availability.
We aim to keep the platform available and reliable. However, we do not guarantee uninterrupted access. We may carry out maintenance, updates, or changes that temporarily affect availability. Where planned downtime is significant, we will give reasonable notice.
Limitation of liability.
To the extent permitted by South African law, Emisha is not liable for indirect, incidental, or consequential losses arising from your use of the platform or website.
Our total liability for any claim arising from these terms is limited to the fees you paid to Emisha in the three months preceding the claim.
Governing law.
These terms are governed by the laws of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
Changes to these terms.
We may update these terms from time to time. Material changes will be communicated to registered users by email. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
